Estate Planning
Cuellar Law Firm is available to help clients in the areas listed below. The list is not exhaustive, so feel free to contact the firm to
discuss your unique situation and inquire into how the firm can help resolve your legal needs. The firm welcomes clients’ questions
and concerns at any stage of what can often times be a difficult and emotionally challenging process.
Wills and Trust Agreements
The firm offers solutions for a variety of clients with needs ranging in
complexity from a simple will to estates that include sizable business
ventures. The firm will compile all necessary instruments to meet the
client’s objectives surrounding the transfer of property and determine the
manner in which assets are to be divided after death. The firm can assist
clients with establishing an estate plan that prevents or reduces the
impact of problems that the client’s estate might face, limits the
administrative burden of estate management, and reduces the risk of
intervention from a probate court into the client’s estate.
Each estate plan is unique and crafted according to each client’s individual
needs. If necessary, a trust can be formed to protect assets and avoid a
extensive probate process. The firm focuses on forming a plan that
protects the client’s property interests, minimizes the impact of taxes and
court fees, and allows the client’s family to retain control over the assets.
Powers of Attorney and Health Care Directives
Due to circumstances such as illness, injury, or age, clients may become
either mentally or physically incapable of caring for themselves or managing
their financial affairs. The firm can assist clients with planning for potential
disability issues. By initiating the proper planning in advance, clients are able
to manage their assets and avoid guardianship and conservatorship
proceedings by designating a dependable individual to handle the client’s
affairs as well as set directives involving life-sustaining treatment and end-of-
life care. The firm will prepare the required instruments to empower
individuals the client trusts to act in their behalf and allow them to carry out
the client’s financial and health care objectives.
In addition to permitting the client to determine decisionmaking authority
over their own financial, property, or other legal affairs, powers of attorney
permit clients to establish objectives as to the care of minor children and
dependents as well.
Elder Law
Elder law encompasses a diverse array of issues impacting older or disabled
clients as well as their family members. Proper long-term care planning may
help alleviate what could otherwise be a significant financial burden imposed
by health care, housing, and nursing home expenses. The firm works with
clients who are concerned over the expenses associated with long-term care
in establishing a plan on qualifying for public benefits, such as funding
available through Medicare/Medicaid and other federal and state programs.
The firm also assists clients with estate planning issues including preparing
wills and trusts, supplemental and special needs trusts, powers of attorney,
health care directives, forming guardianships and conservatorships,
vulnerable adult issues, and nursing home litigation in the event of injury or
death due to substandard care.

Probate and Trust Administration
The exact process involved with each individual probate estate will vary
and can be confusing for an executor of the estate to navigate. The firm
works with clients to prepare the appropriate documents to initiate
probate proceedings and perform various functions involved with
managing the estate, including paying the estate’s debts, collecting money
owed to the estate, compiling an inventory of the estate’s assets,
preparing estate tax returns and fiduciary accountings, and distributing
the estate’s assets among the beneficiaries. The firm can also assist with
collecting non-probate transfers such as life insurance and trusts, and
preparing deeds and other property transfer instruments.
Regardless which side of the process a client is on, the firm is also
available to provide representation in various types of probate and estate
disputes, such as will contests involving claims such as incapacity and
undue influence as well as claims against trustees and fiduciaries.
